Terms of Service (AGB)

§ 1 Scope and provider
(1) These terms govern the use of the "Wandelraum" service at 58fast.com (the "Service") by consumers.

(3) Deviating terms of the user do not apply.
§ 2 Description of the Service; entertainment character
(1) The Service offers AI-supported dialogues on Tarot, Lenormand, I Ching, and dream interpretation. Draw data (cards, positions, orientations, lines, hexagrams) is generated server-side using cryptographically secure randomness, stored, and not altered in the further course of the dialogue.
(2) The Service serves culture, entertainment, and self-reflection only. Readings are generated by artificial intelligence. They contain no factual claims about future events and no statements about the thoughts or intentions of third parties. They do not constitute medical, psychotherapeutic, legal, financial, or investment advice and do not replace professional advice.
(3) The Provider does not warrant that AI-generated content is factually accurate, complete, or suitable for any particular purpose. The user's decisions should always be based on their own assessment and — where appropriate — professional advice.
(4) Crisis notice: The Service is not intended for emergencies or crisis situations. In the event of health crises, risk of self-harm, or other urgent risks, please contact local emergency services or recognized support services (in Germany, e.g. Telefonseelsorge 0800 111 0 111).
§ 3 Requirements for use; accounts
(1) Use of the Service requires that you are at least 18 years of age.
(2) Guest access: The Service can be tried without registration via a device-bound guest account. The user is responsible for protecting access to their device. If the browser's local storage is cleared or the device is changed, a guest account including its dialogues may become irretrievably inaccessible; the Provider accepts no responsibility for this. Inactive guest accounts are deleted after 30.
(3) Registered account: Purchasing credits requires an account linked to an email address (sign-in via email link or via Google/Apple). A guest account can be converted into a registered account by signing in with an email address.
(4) There is no entitlement to the opening or maintenance of an account. Only one free trial allowance is permitted per person.
§ 4 Free trial use
The Provider may grant new accounts a free allowance of AI replies. The scope and availability of the trial allowance may be adjusted at any time with effect for the future; there is no legal entitlement to it.
§ 5 Credits ("AI replies")
(1) Paid services are billed via credits purchased in packages. The prices displayed in the Service at the time of the order apply; all prices are in euros and include statutory VAT.
(2) An AI reply is reserved when requested and only finally consumed after successful delivery. If generation fails, the reserved unit is automatically credited back to the balance. The Provider maintains a history of all transactions, viewable in the account.
(3) Purchased credits are valid indefinitely.
(4) Credits are tied to the respective account, non-transferable, and — subject to statutory rights, in particular the right of withdrawal, and the provisions of the refund policy — not paid out in cash.
§ 6 Conclusion of contract and payment
(1) The presentation of credit packages in the Service is an invitation to submit an offer. By completing the order process via the payment service, the user submits a binding offer; the contract is concluded when the Provider confirms the credit.
(2) Payment processing is handled via Stripe. The statement of the payment method will show "58FAST.COM AI".
(3) The contract text is not separately stored and made available; the transaction history can be viewed in the account. The contract language is German.
§ 7 Right of withdrawal
(1) Consumers have a statutory right of withdrawal for paid contracts. The withdrawal notice and the model withdrawal form at https://www.58fast.com/en/legal/widerruf apply.
(2) If the user requests that performance begin before the withdrawal period expires (immediate usability of the credits), the right of withdrawal remains in place for the portion not yet consumed; for AI replies already consumed, the user owes compensation for value in accordance with the withdrawal notice.
(3) Voluntary goodwill arrangements are set out in the refund policy at https://www.58fast.com/en/legal/refund; statutory rights remain unaffected.
§ 8 Acceptable use
(1) The following in particular are prohibited:
- entering unlawful content or content that infringes third-party rights;
- attempts to circumvent security mechanisms, access, or quota restrictions (including creating a multitude of guest accounts);
- automated scraping or mass querying of the Service without permission;
- using the Service to deceive or harass third parties or to mislead them about the entertainment character of the content.
(2) In the event of violations, the Provider may suspend or terminate accounts after warning — or, in the case of serious violations, without warning. The user's statutory claims to reimbursement of unconsumed, paid-for credits remain unaffected insofar as the user is not responsible for the violation.
§ 9 Rights of use in AI content
(1) The user may use the reading texts generated for them for private, non-commercial purposes.
(2) The Provider does not warrant that AI-generated content is unique or can be used free of third-party rights when used outside the Service.
§ 10 Availability; changes to the Service
(1) The Provider strives for high availability but does not owe uninterrupted accessibility. Maintenance, further development, and disruptions at upstream providers (e.g. AI provider, payment service) may temporarily limit availability.
(2) The Provider may further develop the Service and change features insofar as this is reasonable for the user and contractually promised core services (redemption of existing credits for AI replies) are preserved. If the Service is discontinued, unconsumed, paid-for credits will be refunded.
§ 11 Liability
(1) The Provider is liable without limitation for intent and gross negligence, for damages arising from injury to life, body, or health, and under the German Product Liability Act.
(2) In cases of simple negligence, the Provider is liable only for the breach of essential contractual obligations (obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely), limited to the foreseeable damage typical for the contract.
(3) Liability is otherwise excluded. In particular, the Provider is not liable for decisions the user makes on the basis of reading content (§ 2).
§ 12 Changes to these terms
The Provider may amend these terms with effect for the future where this is necessary for valid reasons (esp. changes in the law, further development of the Service) and reasonable for the user. Registered users will be informed in text form at least six weeks before the changes take effect; if the user does not object within the period, the changes are deemed accepted. The notification will separately point out the right to object and the consequences. Changes to essential performance obligations to the user's detriment require the user's consent.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Vis-à-vis consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their state of habitual residence.
(2) Should individual provisions be invalid, the remainder of the contract remains valid; the statutory provisions apply in place of the invalid provision.
